KABEL is in charge of the client personal data process for the aims and duration detailed down below.

4: AIM AND DURATION OF THE PROCESS

The aims of the client personal data process made by KABEL are:

  1. Maintenance of the commercial relationship with the client including the necessary activity for the implementation of the pre-sell, sell and post-sell services, invoicing, mail publicity sending, telephone, fax or electronic mail, relationship maintenance and loyalty.
  2. The compliance of the legal obligations derived from the commercial relationship with the client.

KABEL process the minimum indispensable client personal data for the aims previously described. None of the processed data is categorized by the current legislation of special protection.

Current legislation establishes as personal data of special protection the following: data that revealed the ethnic of racial origin; the political opinions; the religious or philosophical convictions or the union affiliation; the process of genetic data, biometric data intended for identify in an univocal way a physical person; the data related to the health, sexual life or sexual orientation of a physical person.

Processed personal data have been provided by the client and are identification and bank data.

Client personal data will be held for the time that the commercial relationship lasts or when the client withdraws the express assent, whichever happens before. Nonetheless, some of the client personal data could be maintained limiting its process once finalized the relationship due to legal obligations imposed on KABEL and for the minimum indispensable time for its compliance.

The no express assent or the opposition to the process will mean that KABEL will not be able to perform the necessary activities to maintain a commercial relationship with the client.

5: LEGITIMACY OF THE PROCESS

The legal basis that legitimizes KABEL for the client personal data process are the following:

  1. Express assent of the applicant for the process of its personal data.
  2. The maintenance, in that case, of the contractual relationship between the client and KABEL, and especially in the billing process.

6: RECIPIENTS

KABEL will notify on paper, within the time set by the regulation, the resolution about the claimed rights exercise.

Candidate personal data will be held for the time that the selection process lasts or during ONE YEAR at maximum since the collection by KABEL or until the candidate withdraws the express assent, whichever happens before. Nonetheless, some of the candidate personal data could be maintained limiting its process once finalized the selection process due to legal obligations imposed on KABEL and for the minimum indispensable time for its compliance.

The no express assent or the opposition to the process will mean that KABEL will not be able to perform the necessary activities to select the candidate as KABEL staff.

5: LEGITIMACY OF THE PROCESS

The legal basis that legitimizes KABEL for the employee personal data process are the following:

  1. Execution of the employment contract signed between KABEL and the employee which brings out the obligation to the employee to provide personal data related with identification, address, personal situation, working situation, familiar situation and bank data for the existence of the contractual relationship. The refusal of the employee to the process and release of this data will imply the impossibility to execute the employment contract and offer the social benefits established between both parties.
  2. Compliance of the imposed legal obligations, among others, by the work, social protection, tax and labor administration. The compliance of the previous makes the obligation to provide personal data about identification, address, personal situation, work situation and family situation for its fulfilment. The refusal of the employee to the process and release of this data will imply the impossibility to fulfill the legal obligations of KABEL.
  3. Legitimate interest of KABEL for the work’s direction and the service delivery to their clients that generates the obligation on the part of the employee to provide personal data about identification, academic experience and work experience. The refusal of the employee to the process and release of this data will imply the impossibility to perform the work direction activities object of the employment contract signed between both parties.

6: RECIPIENTS

To complete the marked aim, KABEL will give the minimal indispensable employee data to:

  1. Tax administration
  2. Labor administration
  3. Social security administration
  4. Judicial administration
  5. Organizations that provide services to KABEL for the execution of the benefits derived from the employment contract including payroll and social benefits.
  6. Service organizations that provide KABEL coverage in the fulfillment of the obligations about work accidents or prevention of occupational risks.
  7. Organizations that provide training or certification services to the KABEL employees.
  8. Organizations that provide services to KABEL for its commercial activities as process liable.
  9. Clients or potential clients in which KABEL acts as a service supplier or provider as process liable.
  10. Any recipient in a way of a legal obligation imposed to KABEL.

For the secure access to the KABEL facilities, a fingerprint identification system has been installed. This system captures the employee fingerprint typo and puts it forward an algorithm that stores it along with the name established by the operator. From the moment their fingerprint is stored, the employees will have access to the different facilities of KABEL to which the operator had gave access to by using the fingerprint in the installed scanner.

The aims of the employee personal data process done by KABEL are:

  1. The employees’ access to KABEL facilities and the protection of both the facilities and the employees.

The processed personal data are provided by the employee by their express assent to the implementation of the described aim. The refusal of the fingerprint use for the access to the facilities will not condition the employment contract in any way more than the impossibility to access automatically needing the user to request it every time it occurs.

The employee personal data expressed in this page will be held for the time that the contractual relationship lasts with the employee or when they withdraw their express assent, whichever happens first.

3: LEGITIMACY OF THE PROCESS
